General Terms and Conditions (GTC)

General Terms and Conditions (GTC) for events (lectures, coachings, in-house seminars, workshops and moderations) with the beautiful ugly truth Management Consulting/Tobias Mayer hereafter – Tobias Mayer.
1. Fee
The agreed fee does not include expenses, travel costs, travel costs for briefing discussion and value added tax.

2. Technology
The necessary technology (loudspeaker system, microphone, beamer, screen, flipchart etc.) will be provided by the organizer as agreed upon in advance.

3. Invoicing
Invoicing for the contract fee, expenses and travel costs will take place after the date of the event. The term of payment is 10 days without deduction.

4. Cancellation
In case of cancellation, withdrawal or termination of an order, the following processing fees will be charged:
– up to 90 calendar days before the start of the event: 25 % of the fee
– up to 28 calendar days before the start of the event: 50 % of the fee
– from 15 calendar days before the start of the event: 100 % of the fee

Costs already incurred for accommodation and travel to and from the event at the time of cancellation are to be borne by the organizer upon presentation of proof.

5. Withdrawal and termination declarations
Cancellation and termination declarations must be made in writing. The date of receipt of the withdrawal or termination declaration is decisive.

6. Force majeure
If a date for the contribution of the achievement cannot be kept by Tobias Mayer due to higher force, accident or illness, we try to provide immediately for an adequate replacement.

7. Recordings and recordings
Recordings of lectures and seminars with Tobias Mayer on sound carriers are not possible for copyright reasons – also not for internal use – and/or require a detailed agreement in advance.

8. Public seminars and lectures
For all public seminars and lectures the terms and conditions of the respective organizer apply.

9. Warranty
The warranty is governed by the statutory provisions.

10. Liability
10.1 Tobias Mayer is responsible without limitation for resolution and rough negligence.
10.2 For simple negligence Tobias Mayer is responsible – except in the case of the injury of the life, the body or the health – only, if substantial contract obligations (cardinal obligations) are hurt. The liability is limited to the contract-typical and foreseeable damage.

10.3 Liability for indirect and unforeseeable damage, loss of production and use, loss of profit, loss of savings and financial losses due to claims by third parties shall be excluded in the case of simple negligence – except in the case of injury to life, limb or health.

10.4 Any further liability than provided for in this contract shall be excluded – irrespective of the legal nature of the asserted claim. However, the above limitations or exclusions of liability shall not apply to strict liability prescribed by law (e.g. under the Product Liability Act) or to liability under a strict warranty.

10.5 As far as the liability according to clauses 2 and 3 is excluded or limited, this also applies to the personal liability of Tobias Ködel’s employees, representatives, organs and vicarious agents.

11. Confidentiality/Data protection

Confidentiality is agreed about the contractual contents and conditions. Any disclosure of this information is prohibited. An offence can result in claims for damages. This obligation to maintain secrecy shall continue beyond the end of the contractual relationship.

12. Choice of Law/Place of Jurisdiction

12.1 German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. With respect to consumers, this choice of law shall only apply to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the contractor has his habitual residence.

12.2 If the contractual partner is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction shall be the registered office of the company the beautiful ugly truth Management Consulting/Tobias Mayer. The same applies to persons who do not have a general place of jurisdiction in Germany or persons who have moved their place of residence or habitual abode outside of Germany after conclusion of the contract or whose place of residence or habitual abode is unknown at the time the action is filed.
